1. Terms
By accessing content of this website (at https://www.elementalkinetics.com), you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
2. User License
Permission is granted to view the materials (information or software) on Elemental Kinetics LLC's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
modify or copy the materials;use the materials for any commercial purpose, or for any public display (commercial or non-commercial);attempt to decompile or reverse engineer any software contained on Elemental Kinetics LLC's website;remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server.

3. Refunds & Cancellation Policy
Clients who purchase or pay for monthly membership may cancel at any time. Cancellation will result in loss of access to all video and live content.
Clients purchasing individual sessions or private session packages acknowledge the relationship as at will.
Clients must use session packages within 60 days. Private sessions within packages unused at the end of 60 days may be rescheduled or extended at the discretion of Elemental Kinetics LLC.
Elemental Kinetics LLC is dedicated to it’s clients and their welfare and agrees to make every effort to accommodate scheduling to fit within the 60 days.
Elemental Kinetics LLC requires 24 hour notice from clients to cancel private sessions. Rescheduling a cancelled session without 24 hours notice is not guaranteed.
No shows without notice will not be rescheduled or refunded.
Cancellations by Elemental Kinetics LLC may include but not be limited to: Illness, Injury, Technology failure, Travel, Family emergency. Every effort will be made to give clients advance notice and reschedule the missed session or class.
Refunds: Cancelling or terminating private sessions from pre paid session packages. Completed sessions will be calculated at the full price rate of $1.00 per minute.The remaining amount can be refunded.
For example If the client used two 90 minute sessions and wanted a refund for the remaining two 60 minute sessions and the cost of the package was 250$ the refund would be 250 less 180=$70.00
Cancelling packages does not necessarily cancel access to any bonus video course content included in the package.
Elemental Kinetics LLC reserves the right to terminate a client relationship/membership if at any time the client acts in an unsafe, aggressive, inappropriate or abusive way toward any instructor, provider or other member.
4. Disclaimer
The materials on Elemental Kinetics LLC's website are provided on an 'as is' basis. Elemental Kinetics LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Elemental Kinetics LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
5. Limitations
In no event shall Elemental Kinetics LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Elemental Kinetics LLC's website, even if Elemental Kinetics LLC or a Elemental Kinetics LLC authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Elemental Kinetics LLC does not warrant that any of the materials on its website are accurate, complete or current. Elemental Kinetics LLC may make changes to the materials contained on its website at any time without notice. However Elemental Kinetics LLC does not make any commitment to update the materials.

Client acknowledges that this agreement is executed under seal and is subject to the statute of limitations applicable to arguments under seal. These terms and conditions are governed by and construed in accordance with the laws of North Carolina and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.Client acknowledges having read this agreement and having received a copy of it.
